CONSTITUTIONAL GUARANTEES AND JURISDICTIONAL EFFICIENCY IN THE MEGA CRIMINAL PROCESS

This article analyzes the origin and characteristics of the criminal mega-trials, as part of the expansion movement of Criminal Law. Based on the concept formulated by Ferrajoli, the criticisms made to it are analyzed from its characteristic cores and the paradigmatic cases that occurred in Italy at the end of the 20th century. Thus, it seeks to provoke due dogmatic, legislative and legal treatment to a phenomenon that differs from ordinary criminal proceedings not only for its size and complexity, but for its political, social, historical and economical consequences, in order to enable better procedure by legal agents when faced with the institute.
