The Convention on the Rights of the Child on Its Tenth Anniversary: Progress, Effectiveness, and Challenges

Abstract

The article analyzes the Convention on the Rights of the Child ten years after its adoption, with the aim of evaluating its normative progress, its degree of effectiveness, and the limits of the international monitoring mechanism established to oversee its implementation. It adopts a legal-analytical and critical-descriptive methodology based on the examination of the historical evolution of international child protection, the normative structure of the Convention, the functioning of the Committee on the Rights of the Child, and specialized human rights scholarship. It shows that the Convention represented a decisive milestone by giving binding force to the comprehensive protection of children and adolescents and by consolidating the centrality of their economic, social, and cultural rights, but emphasizes that its effectiveness remains compromised by the fragility of supervisory mechanisms, the insufficiency of concrete state commitments, and the absence of sanctioning instruments and individual complaint procedures. The article also highlights the relevance of the Committee as an institutional forum for monitoring, issuing recommendations, and articulating with international organizations and non-governmental organizations, although it points to its slowness, the failure of several States to submit reports, and the limited coercive force of its concluding observations. It concludes that the Convention is a historic achievement within the international human rights system, but its full effectiveness depends on strengthening its monitoring mechanism, mobilizing civil society, and ensuring the effective commitment of States to the material implementation of children’s rights.
