Childhood Obesity Resulting from Parental Neglect: Liability and Applicable Measures

This article aims to analyze parental liability for childhood obesity as a concept consistent with the constitutional doctrine of comprehensive protection. It identifies parental neglect regarding children’s nutrition and health as an unlawful act subject to civil and administrative liability and examines circumstances in which such conduct may also constitute a criminal offense. The study further evaluates the measures provided for in legislation, with the objective of identifying those most appropriate to each specific case.
