The Legal Possibility of Establishing Criminal Incriminating Norms through International Treaties

This study argues for the possibility of creating criminal incriminating norms through international treaties, contrary to the position repeatedly adopted by the Federal Supreme Court. It is maintained that, in light of the (at least) supralegal status attributed to human rights treaties in Brazil, there is no legal restriction on the establishment of criminal incriminating provisions through international agreements.
