Abstract

This article presents a legal thesis that examines the moment of consummation of the crime of rape under Article 213 of the Brazilian Penal Code, in light of the case law of the Superior Court of Justice (STJ). It adopts a comparative approach with the crime of extortion and STJ precedent No. 96 in order to identify interpretative inconsistencies surrounding the concept of coercion.
