This article addresses the theme of the theory of punishment, in a study that questions the contradictory persistence of high incarceration rates under the 1984 Penal Reform, which was originally intended to reduce imprisonment. From that point on, the article seeks to identify trends in comparative law and international law in order to broaden the scope of analysis of the proposed topic. The methodology used is a bibliographic and legislative review, and the study concludes that high incarceration rates are not supported by legislation, nor are they supported by a human rights perspective.
