Abstract

The article analyzes the systematic way in which the normative instruments that regulate and apply custodial sentences in the legal system have been produced over the last forty years of criminal policy practice in Brazil. It highlights the contradiction between the expansionist criminal policy regarding the aggravation of the custodial sentence and the criminal policy that seeks to reduce it, replace it and even not apply it as a way of circumventing the financial costs of its execution.
