Abstract

This study analyzes the scope of the arguments employed in the judgment of RE 593,727/MG, which recognized the authority of the Public Prosecution Service of the Federative Republic of Brazil to conduct direct and autonomous criminal investigations. Based on critical considerations, the article challenges the majority reasoning of the decision and proposes a reflection on the role that the Federal Supreme Court could have assumed by addressing controversial aspects surrounding the issue. The reader is encouraged to reflect on the delineation of the content embedded in the legal grounds that authorized the consolidation of this investigative power, emphasizing the importance of prioritizing its democratic dimension, as well as establishing appropriate mechanisms of oversight to ensure the proper exercise of this authority while safeguarding fundamental rights and guarantees.
