Procedural Deadlines and Their Innovations in the New Brazilian Code of Civil Procedure

With the enactment of Law No. 13,105/2015, which introduced the new Brazilian Code of Civil Procedure, numerous changes were implemented in the national procedural system, particularly with regard to procedural deadlines. Among these changes, noteworthy are the rule establishing that deadlines set in days—whether defined by law or by the judge—are to be counted in business days, as well as the standardization of appellate deadlines to fifteen (15) days, except in the case of motions for clarification. The primary objective of this article is to analyze the changes introduced by the new Code of Civil Procedure, specifically those related to procedural deadlines and the criteria for their calculation, which, as a rule, are now based on business days. Finally, a comparative table is presented contrasting the deadlines under the 1973 Code of Civil Procedure and the new Code, with the aim of clearly demonstrating the changes introduced.
