Socio-Educational Straitjacket: Compulsory Institutionalization as a Protective or Punitive Measure for Adolescents in Conflict with the Law?

This article proposes an analysis of the application of protective measures involving compulsory institutionalization of adolescents in conflict with the law. Although judicial intervention aimed at ensuring treatment for severe mental or behavioral disorders resulting from substance dependence may be considered legitimate, such a measure is argued to be a last resort and must necessarily be supported by technical assessments and family input. The study also examines the constitutionality and feasibility of compulsory institutionalization, taking into account the (non)existence of public policies or governmental programs specifically directed at adolescents with substance dependence.
